The Office de Tourisme des Portes de Sologne, whose head office is located at Rue des Jardins in La Ferté Saint-Aubin, SIRET number 200 005 932 000 54 (hereinafter referred to as "the OPERATOR"), operates an intermediation website between people wishing to sell and buy accommodation, sightseeing or leisure services, accessible at www.tourisme-ccportesdesologne.fr (hereinafter referred to as "the Site").
By connecting to the Site, the User, defined as any person accessing the Site, visiting the Site or making an online reservation with a Service Provider (hereinafter referred to as the "User"), undertakes to comply with the terms of these general conditions. Failing this, the User agrees to leave the Site.
Access to the Site implies irrevocable acceptance of the present terms and conditions, which all Users acknowledge having read. The OPERATOR reserves the right to modify these terms and conditions at any time and at its sole discretion. The general terms and conditions in force are those present on the Site at the time the User accesses the Site or has accepted them electronically in the case of an online reservation.
By accepting these terms and conditions, all Users guarantee that they are of legal age and have full legal capacity to access the Site and/or make an online reservation on the Site with a Service Provider.
The OPERATOR provides a copy of these terms and conditions on a durable medium that can be downloaded from its website, which the User accepts.
The User also agrees to receive all information concerning the execution of these general terms and conditions by e-mail.
The User, who makes a reservation online, acknowledges that acceptance of the general conditions of use is made online on the Site and does not require a handwritten signature.
If the User wishes to make an online reservation with a Service Provider, he acknowledges that, in addition to accepting these general terms and conditions of use, he must also accept the Service Provider's general terms and conditions of sale, failing which he will not be able to make an online reservation.
For the purposes of these terms and conditions, "Provider" means any professional or private individual listed on the Site who offers Users accommodation and/or sightseeing and/or leisure services.
Description of the intermediation service and online booking process
The Site is a platform for online booking of accommodation and/or sightseeing and/or leisure services from Providers.
The Operator is only an intermediary between a buyer and a seller of accommodation and/or sightseeing and/or leisure services, and puts the seller and the buyer in contact with each other.
The sale is made between the User and the Provider.
The User can access the Provider's offers directly on the Site, or by performing a search using selection criteria in the search bar.
When the Provider allows it, the User can make a reservation directly online on the Site with the Provider of his/her choice. To do so, the User must accept and be bound by the Service Provider's general terms and conditions of sale.
In order to make an online reservation, where possible, the User must follow the steps below:
The User must select the accommodation, tour and/or leisure service on the desired date, and add it to his/her basket.
The User must repeat this step as many times as he/she wishes to make a reservation.
Once the User has selected all the bookings they wish to make, they must click on the "Confirm my basket" tab.
The User must then fill in a form, without creating an account, by entering a certain number of details such as surname, first name, postal address, e-mail address, telephone number, etc. The User will then be able to access the reservation page.
The User will then be taken to a booking summary page.
In order to finalize the booking, the User must accept the present general terms and conditions of use, as well as the general terms and conditions of sale of the Service Provider(s) with whom he/she has made a booking, by ticking the box "I accept the General Terms and Conditions of Use of the www.tourisme-ccportesdesologne.fr website, and I acknowledge that I have read and accept the General Terms and Conditions of Sale of the product(s) selected".
Once the reservation has been definitively confirmed, the User must choose the payment method he/she wishes to use for each reservation made, according to the different payment methods offered by each Service Provider.
The User guarantees the truthfulness of the information provided on the Site. The User must inform the SERVICE SUPPLIER of any change in his contact details and assumes all responsibility for any such change.
The User is hereby informed that he/she is responsible for all telecommunication costs incurred in accessing the Internet. The User is informed that in the event of prolonged inactivity during connection, it is possible that the selection of selected services will no longer be guaranteed. In this case, the User must restart the process from the beginning.
The User is informed that he/she may return to the previous pages and correct any errors and/or modify his/her choice and the data provided, before definitively confirming his/her reservation.
Booking confirmation
Confirmation by the Service Provider constitutes final validation of the reservation.
Once the reservation has been definitively validated, the User will no longer be able to cancel the reservation.
The Customer will receive an email confirming the reservation and payment, with a summary of the reservation, as an "acknowledgement of receipt" of the reservation from the Provider with whom he/she has made a reservation.
If the User decides to pay by cheque or bank transfer, depending on the methods of payment accepted by the Provider, the User will make a pre-reservation which will only be confirmed when the Provider has received the cheque or the bank transfer has been credited to the User's bank account.
Confirmation of the reservation will be sent to the e-mail address provided by the Customer in the reservation form.
If the User does not receive a confirmation e-mail from the Provider with whom he/she has made a reservation, he/she should call the Provider directly to request confirmation of his/her reservation.
In the event of a simultaneous double booking and the User being unable to make the booking on the date requested, the Provider will inform the User and will contact the User to reschedule the date or refund the User.
Right of withdrawal
The User, who has made an online reservation on the Site for an accommodation and/or tour and/or leisure service, does not have a right of withdrawal, in accordance with the provisions of the French Consumer Code, which states that the right of withdrawal cannot be exercised for contracts for the provision of accommodation services, other than residential accommodation, and for contracts for leisure activities which are to be provided on a specific date or at a specific time.
Reservation management directly with the Provider
If the User has any questions concerning his/her reservation and stay, he/she should contact the Provider directly to ask his/her questions.
If the User wishes to cancel or modify a booking, he/she should read the cancellation and/or modification conditions set out in the Provider's general terms and conditions of sale and make a request to this effect, if possible, directly with the Provider.
Any refund of all or part of the reservation price, in the event of cancellation or modification of the reservation, will be the responsibility of the Provider and in no case of the OPERATOR.
If the User has a complaint concerning his/her reservation or stay, he/she must make the complaint directly to the SERVICE SUPPLIER.
The OPERATOR shall in no way be held responsible for any disputes concerning the User's reservation or stay.
Referencing
To be listed on the Site, the Service Provider must offer a service in one of the five departments of the Loire Valley and be listed in the OPERATOR's regional database.
Service offers can be sorted by location, classification, label, price and desired reservation date. When the User searches by desired booking date, offers that can be booked online on the Site will appear first.
The OPERATOR also favors offers with photographs, which will appear first. As the Photographs are supplied by the Service Provider, the OPERATOR cannot be held responsible if the Photographs do not correspond to reality. Subject to the aforementioned elements, offers appear randomly and change according to browsers and times of day.
The User may access the information provided for in articles L. 221-5 and L. 221-6 of the French Consumer Code:
By clicking on the link provided for this purpose on the Site, which will redirect them to the professional's website, where the said information will be indicated;
or in the space provided on the Site for professionals who do not have a website;
or in the Service Provider's general terms and conditions of sale.
Certain Providers will be listed on the Site, but the User will not be able to make a reservation with them directly on the Site. This depends on the Provider's choice at the time of listing on the Site. In this case, the User must contact the Provider directly to make a reservation.
Prices
Prices are shown in euros, inclusive of all taxes.
The prices displayed on the Site are the prices communicated by the Providers.
They may be subject to change by the Provider.
The price applicable to the User will be the price in force at the time of validation of the User's reservation on the Site.
Applicable taxes are those in force on the day of booking.
Payment for bookings may be made on the Site, if the Provider has chosen this method of booking, by credit card, or by bank transfer or cheque, depending on the methods of payment accepted by each Provider, which will be indicated on the Site. If the Provider has not chosen this booking method on the Site, the User must contact the Provider directly to make a booking.
The total amount paid by the User will be paid directly to the Provider.
Liability
As the OPERATOR is a platform for putting Users and Providers in contact, and does not intervene in their relationship, whatever it may be, it declines all responsibility in the event of a dispute between a User and a Provider, whatever the basis and cause.
The User is subject to compliance with the Provider's general terms and conditions of sale, which he will have accepted online before making his reservation.
The OPERATOR makes no commitment concerning the quality of the services provided by the Providers. Sales are made directly between the User and the Service Provider.
The equipment enabling the User to connect to the website is under the User's sole responsibility. He must take all appropriate measures to protect his equipment and his own data, in particular from viral attacks via the Internet. The User is solely responsible for the sites and data he/she consults.
Intellectual property
All trademarks, photographs, texts, comments, illustrations, images (animated or not), video sequences, sounds, all computer applications that may be used to operate this site, all downloadable documents and, more generally, all content present on the www.tourisme-ccportesdesologne.fr website are protected by current intellectual property laws.
They are the full and complete property of the operator or third parties to whom they belong. Any reproduction, representation, use, communication, marketing or adaptation, in any form whatsoever, of all or part of the aforementioned elements, including computer applications, without the prior written consent of the Office de Tourisme des Portes de Sologne, is strictly forbidden.
The fact that the operator does not initiate proceedings as soon as it becomes aware of such unauthorized use does not constitute acceptance of said use or waiver of prosecution.
The User shall refrain from any act of counterfeiting, unfair competition or parasitism against the OPERATOR, and shall refrain from defaming or denigrating the OPERATOR.
Personal data
The User is hereby informed that the personal data provided on the Site will be processed by L'EXPLOITANT for the purposes of monitoring user relations, compiling statistics and managing reservation requests.
If the User is asked to fill in a questionnaire, the OPERATOR will indicate whether answers are compulsory or optional at the time of data entry. The data is recorded in the operator's customer file. The data will also be communicated to the Service Provider with whom the User has made a reservation on the Site, so that it can process the reservation.
This processing has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL).
The data is kept by the OPERATOR for the time required to fulfil the purposes for which it was collected.
The OPERATOR reserves the right to send the User a newsletter or offers related to the services offered on the Site, by electronic means, sent to the address given by the User on the Site. If the User no longer wishes to receive newsletters or offers, he/she may object at any time by clicking on an electronic link provided for this purpose in the newsletter or offer e-mail.
In accordance with the provisions of the French Data Protection Act no. 78-17 of January 6, 1978, as amended, the User has the right to access, rectify and delete any data concerning him or her, which he or she may exercise at any time by contacting the operator either directly on the site under the heading "Contact us", or by post to the following address: Office de Tourisme des Portes de Sologne, Rue des jardins, 45 240 La Ferté Saint-Aubin. COOKIES

Insurance
The User shall be personally responsible for taking out the necessary insurance in the event of the practice of a sport or leisure activity, or any other activity requiring insurance for any damage suffered or caused to a third party. The OPERATOR shall not be held liable in any case.
Force majeure
The obligations of the OPERATOR will be suspended in the event of force majeure, without the User being able to hold the OPERATOR liable.
The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the Jurisprudence of French Courts and Tribunals: total or partial strikes, internal or external to the company, in particular of postal services, lock-outs, bad weather, epidemics, earthquakes, fire, storms, floods, water damage, blocking or malfunctioning of telecommunications, blocking or malfunctioning of the Internet, governmental or legal restrictions, legal or regulatory changes to forms of marketing, and any other event beyond the express control of the parties preventing the normal performance of the present contract.
Internet limitations
The User acknowledges that he/she is aware of the characteristics and limitations of the Internet, of the possible presence of viruses, and of the possible misappropriation of the User's data due to acts of piracy, for which the OPERATOR cannot be held responsible. The same applies in the event of difficulties accessing the Site or malfunctions on the Site, in particular due to acts of piracy. The OPERATOR reserves the right to interrupt services as part of maintenance operations, and cannot be held liable in this respect.
Site maintenance
For the proper management of the site, the operator may at any time suspend access to the site in order to carry out updates, or more generally for the maintenance of the website. The operator shall not be held liable for any such suspension.
Modification of the Site and its content
The OPERATOR reserves the right to modify or delete, at any time, all or part of the Site and/or the Service, without this giving rise to any right to compensation for the User.
Evidence agreement
The User acknowledges and accepts that the information contained in the computer systems of the OPERATOR or the Service Providers has the same evidential value as paper documents, with regard to acceptance of these general terms and conditions. Electronic documents are archived on a reliable and durable medium that can be produced as evidence.
Independence of the provisions of the general terms and conditions
Should any provision of the present terms and conditions be declared null and void or inapplicable as a result of a court decision or the application of a law or regulation, the remaining provisions of the present terms and conditions shall remain in force.
Applicable law and settlement of disputes
These terms and conditions are governed exclusively by French law.
The User is hereby informed of the possibility, in the event of a dispute concerning the present terms and conditions of use, of resorting to a conventional mediation procedure or any other alternative dispute resolution method with a view to the amicable resolution of the dispute, or of bringing an action before a competent court.
In the event of a dispute with a Service Provider, the User should consult the Service Provider's general terms and conditions of sale or contact the Service Provider to find out the name of the consumer ombudsman to whom he/she may turn, if he/she so wishes.
